Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.


Privacy Statement We are committed to protecting your privacy. Authorized employees within the company on a need to know basis only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers. Parliament has created specific offences for unauthorised actions against computer systems and data. Client records are regarded as confidential and therefore will not be divulged to any third party, other than [our manufacturer/supplier(s) and] if legally required to do so to the appropriate authorities. Clients have the right to request sight of, and copies of any and all Client Records we keep, on the proviso that we are given reasonable notice of such a request. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Client’s with appropriate written information, handouts or copies of records as part of an agreed contract, for the benefit of both parties.
We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products.

Data Collection and User Privacy

We collect data for use in analising user trends on this website. We do not sell or use this data for any other purpose.

Disclaimer

Exclusions and Limitations The information on this web site is provided on an "as is" basis. To the fullest extent permitted by law, this Company:

Quote

We offer free website quotes. If you find a cheaper/better deal we will beat it. Conditions - You must host your website with us. You domain name must be registered through us, or transfered to us. Can only be compared to one other quote. Other quote must contain elements that you want in your website, not a general quote.

Payment

Cash, Direct Deposit or Cheque, all major Credit/Debit Cards are acceptable methods of payment. Pay Pal and Ezy Debit payment system have associated fee's. Our Terms are payment in full within fifteen days. All goods remain the property of Bright Sky Media and Marketing until paid for in full. We reserve the right to seek recovery of any monies remaining unpaid sixty days from the date of invoice via collection Agencies and/or through the Small Claims Court in the event that the outstanding balance does not exceed $3000. In such circumstances, you shall be liable for any and all additional administrative and/or court costs.

Returned cheques will incur a $5 charge to cover banking fees and administrative costs. In an instance of a second Returned cheque, we reserve the right to terminate the arrangement and, if agreed to, we shall insist on future cash transactions only. Consequently, all bookings and/or transactions and agreements entered into will cease with immediate effect until such time as any and all outstanding monies are recovered in full.

Invoicing (Domains/Products and Services)

Invoice is due on the date on the invoice. A reminder will be sent at 3, 7 and 14 days. At 15 days no payment suspension will occur. At 21 days no payment Termination OR 50% late payment fee. Notification for Domain renewals occurs 60 + 30 days before due date.

Website Design & Development

All developments with any CMS or site builder (Joomla! Wordpress, etc), come with current (at time of design unless receiving reports as part of your service) most recent update. A maximum of seven (7) design changes on the style template (the design) for each website.

Hosting and Domain Names

All hosting and domain name registrations are for one (1) year unless otherwise stated. The client will be notified one (1) month before Hosting is due. Hosting will be cancelled if hosting is not paid. Hosting costs are subject to change with 30 Days notice, current plans are honoured and will change from the registration due date. Site Builder included hosting and software registration for one (1) year. Site Builder cannot be transfered to other hosting providers. Website Development sites created by Bright Sky can be relocated. Website Development and Design, requires hosting and a domain name. If you have purchased hosting elsewhere, bright sky will credit the hosting free to bright sky hosting. Backup are performed on the server nightly. It is recommended that you purchase the reports package for additional backups to a remote server in the event of server problems on the main server, this is a fail safe.

Emails

We will not tolerate SPAM, Mass EMail or Unsolicited Emailing. Mass Email - We classify mass email as over 100 Email per send/recieve, per hour. To increase email options, please ask us about a dedicated server. Unsolicited Email - Is general normal email that was not requested by the recipient. SPAM - A message that is both Unsolicited and Mass Email. We have guidelines that you can ask us about regarding your emails.

INODES

The use of more than 50,000 inodes on any shared account may potentially result in suspension. Accounts found to be exceeding the 50,000 inode limit will automatically be removed from our backup system to avoid overusage. Every file (a webpage, image file, email, etc) on your account uses up 1 inode. Sites that slightly exceed our inode limits are unlikely to be suspended; however, accounts that constantly create and delete large numbers of files on a regular basis, have hundreds of thousands of files, or cause file system damage may be flagged for review and/or suspension. Over time, tens of thousands of messages (or more) build up, eventually pushing the account past our inode limit. To disable your default mailbox, login to cPanel and choose "Mail", then "Default Address", "Set Default Address", and then type in: :fail: No such user here

When the Services Will be Available

We will attempt to provide the services 24 hours a day, 7 days a week for as long as you have paid for them. Sometimes, however, for a number of reasons, the services may be unavailable to you. You must recognize and acknowledge that due to the nature of web hosting technology, occasional unavailability of the services cannot be avoided. Sometimes there are equipment malfunctions. At other times we undertake periodic maintenance procedures or repairs. Still other times, there are causes beyond our control like power failures, interruption or failure of telecommunication or digital transmission links, hostile network attacks, network traffic and other occurrences. We have not promised to provide you with uninterrupted service.

All products and services that use any parter applications are only valid for the duration and lifetime of that application/product.

Affiliate Program

Affiliates of Bright Sky Media earn 10% commision on all sales. Payout are availble after 30days as long as the product/service is still active.

Domain Ownership and Management

We will also offer support & management of your domain to the extent of nameservers & email accounts. Your domain will always be owned by you. If you purchased your domain free with a package you will not control the domain if the package expires. If your domain expires at any time, it will be used for advertising purposes.

Website Reports and Maintenance

This service is $59 monthly.Setup Fee may be required if SEO is not part of your package. You agree to a 12 month contract amounting to $708. A Cancellation Fee of $50 will be charged for breaking agreement.

Cancellation Policy

Minimum 48 hours notice of cancellation required. Notification for instance, in person, or via the phone, will be accepted subject to confirmation in writing. We reserve the right to levy a $50 charge to cover any subsequent administrative expenses.

Termination of Agreements and Refunds Policy

Both the Client and ourselves have the right to terminate any Services Agreement for any reason, including the ending of services that are already underway. No refunds shall be offered, where a Service is deemed to have begun and is, for all intents and purposes, underway. Any monies that have been paid to us which constitute payment in respect of the provision of unused Services, shall be refunded.

All advertising is intended solely for the Australian market. You are solely responsible for evaluating the fitness for a particular purpose of any downloads, programs and text available through this site. Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or any other means, without the express written consent of the Company. The Company does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best ability. By using this service you thereby indemnify this Company, its employees, agents and affiliates against any loss or damage, in whatever manner, howsoever caused.

Log Files We use IP addresses to analyse trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within this Company on a need-to-know basis. Force Majeure

Waiver

Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.
